This privacy statement and notice of privacy practices (“Privacy Policy”) describes the privacy practices of AdKaddy, Inc. and/or its subsidiaries and affiliates (collectively, “AdKaddy”) located in the United States.  For the purpose of the following terms, references to “We”, “Us” and “Our” include AdKaddy and its affiliates, subsidiaries, agents, representatives, successors and assigns. 

 

We provide a website and mobile-based application that offers a marketplace for consumers to interact with various third party businesses (collectively, the “Application”).  This Privacy Policy is applicable to all data collection by AdKaddy and shall apply to the user’s (“You” or “Your”) use of the Application.  This Privacy Policy describes how AdKaddy treats Your use of the Application, including the collection, storage, and handling of Your personal information and Your use of the Application.  This Privacy Policy shall apply strictly to users’ information collected in the United States.

 

BY USING THE APPLICATION, YOU AGREE TO OUR COLLECTION PRACTICES, USE PRACTICES, AND OTHER ACTIVITIES AS DESCRIBED IN THIS PRIVACY POLICY.  IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY, THEN DO NOT DOWNLOAD OR USE THE APPLICATION.

1)     Changes and Updates to this Privacy Policy

AdKaddy reserves the right to revise or update this Privacy Policy at any time, to the extent permitted under applicable law, and You agree to be bound by those revisions or updates.  AdKaddy will notify You of any changes to the Privacy Policy by posting the revised or updated Privacy Policy within the Application.  Any modifications or updates are effective immediately upon posting.  Your use of the Application thereafter constitutes Your agreement to and acceptance of the Privacy Policy and its revisions or updates.  You should periodically read the Privacy Policy to learn of any revisions or updates.  This Privacy Policy incorporates by reference the terms of service (the current version of which can be found at https://www.adkaddy.com/terms (the “Terms of Service”), as may be modified from time to time without notice, that apply with respect to Your use of the Application.

3)    Types of Information Collected and How it is Collected

The types of information We collect from You when You access or use the Application are listed below.  AdKaddy does not share Your Information with any unaffiliated third parties.  AdKaddy is not responsible for the privacy practices of any other websites or third parties.  You should review the terms of use and privacy policies that are posted by those third parties, before using any services, websites, or applications they provide.  AdKaddy accepts no liability for any information, products, advertisements, content, services, or software accessible through these third party websites or for any action You may take as a result of linking to any such website.  We collect information directly from You through use of the Application

3.1.     Personal Information We Request From You

Certain functions of the Application (e.g. creating a user account) will require You to provide personal information to AdKaddy.  That personal information may include Your name, phone number, e-mail address, mailing address, zip code, username, password, credit card information, social security number, birth date, criminal history, bank account information, citizenship status, previous work experience, education background, and federal employment identification number.  By submitting this personal information to AdKaddy, You agree that AdKaddy may use the information in accordance with this Privacy Policy, for example to provide You with functions of the Application, match Your interests with advertisements and advertisers, adapt and improve AdKaddy services to better suit Your needs, provide benefits entitled to You, and to meet regulatory or contractual requirements relating to the functions provided to You. 

 

AdKaddy may also use this personal information in other ways, such as to provide You with information about offers that may be of interest to You, to seek follow-up from You about Your experiences with AdKaddy, or as otherwise disclosed to You at the point of collection.  Where required, AdKaddy will seek Your express consent to send such messages, including when sent by e-mail or other type of commercial electronic message.  You may withdraw Your consent by using the “unsubscribe” link located at the bottom of such messages You receive from AdKaddy to the extent applicable, or by contacting AdKaddy at the email or postal address listed in this Privacy Policy.

 

To the extent required by applicable federal or state law, AdKaddy may be required to disclose Your personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.  By submitting personal information to AdKaddy, You give AdKaddy permission to receive it, review it, store it, and use it for the purposes described in this Privacy Policy.

3.2.     Other Types of Information We Collect

AdKaddy also gathers certain information about Your shopping and advertising preferences, how You use the Application, including the frequency of visits, and other information that may help AdKaddy improve the customer experience, mitigate fraudulent activity, and comply with legal requirements.  Such information may include, but is not limited to, the following:

 

Log Information

When You visit AdKaddy’s Application, We automatically collect and store certain information in Our server logs.  This type of information includes details of how You interacted with the Application. It may include information such as: IP address, Unique Device Identifier, or CallerID / ANI (Automatic Number Identification) information, content of advertisements, transaction with APIs (Application Program Interface), transactions with IVR (Interactive Voice Response) systems, activity, and content of visitor interaction with call center representatives; Application usage activity, hardware information, and hardware and system settings.

 

Automatic Collection

AdKaddy uses cookies or similar technologies to analyze trends, administer AdKaddy’s Application, track users’ movements around the Application, and to gather demographic information about Our user base as a whole.

 

Cookies

A cookie is a small, data file that is managed by an application and stored on Your local device.  AdKaddy uses session and persistent cookies to, among other things, identify Your device during a particular interaction and analyze Your behavior during a particular visit.  Most applications provide You with the ability to accept or decline cookies, as well as to be warned each time a cookie is being sent.  If You choose to decline cookies, You may not be able to fully use AdKaddy’s Application.

 

Pixel Tags

Pixel tags help AdKaddy better manage user experience and content tracking.  Pixel tags are tiny graphics with unique identifiers, which provide a similar function to cookies and are used to track user interaction with content provided by AdKaddy or an advertiser.  In contrast to cookies, which are stored on a user’s device, pixel tags are embedded invisibly within content.  The small size and transparency of pixel tags are not intended to deceive content recipients, but minimize distraction.

 

Do Not Track and Third Party Advertising Cookies

Do-Not-Track is a public-private initiative, http://www.w3.org/2011/tracking-protection/, that has developed a technical “flag” or signal that an end-user may be able to activate within their browser software to notify applications that they do not wish to be “tracked” by third parties as defined by the initiative.  The initiative, however, has not reached a consensus as to exactly what technical or other actions those parties receiving the signal should take.  As a result, Do-Not-Track has not yet been standardized and most applications, including AdKaddy, do not alter their behavior or change their services when they receive a “do-not-track” flag or signal.  You can, however, make decisions about Your privacy and the advertisements You receive.

 

Some of the ads You receive on applications are customized based on predictions about Your interests generated from Your visits to different applications.  This type of advertisement customization is sometimes called “online behavioral” or “interest-based” advertising.

 

As an alternative to the opt-out, You can also elect to block all cookies from first parties (such as AdKaddy) and from third parties (such as any entities involved in advertising) by using the cookie blocking options built into Your device. 

4)    Retention and Deletion of Personal Information

AdKaddy will retain Your personal information for as long as necessary to fulfill the purpose(s) for which it was collected and to comply with applicable laws.  When personal information is no longer needed or legally required, it will be permanently deleted or de-identified so that it can no longer be associated with a specific individual.

5)     Use of Personal Information

In addition to any of the previously mentioned uses of personal information, AdKaddy may use Your information collected on the Application for such purposes as: (a) helping to establish and verify Your identity; (b) activating and maintaining Your account; (c) for tax purposes; (d) contacting You to offer updates and notices, promotional notices, and other information about the Application or other services available from AdKaddy; (e) providing You with advertisements You have requested or authorized; (f) responding to Your questions, inquiries, comments, and instructions; (g) improving the Application by solving technical problems, calculating overall usage statistics, internal marketing, and promotional purposes, and Application development and content improvement; (g) taking good-faith steps to enforce the terms and conditions of the Terms of Service; and (h) maintaining the security and integrity of the Application and AdKaddy’s systems.

AdKaddy's use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements."

6)      Disclosure of Personal Information

We may disclose Your personal information in the following instances:​​

  • To fulfill a service to You.  For example, if You e-mail Us a question, We may use Your e-mail address to process Your request and respond to Your question.

  • To comply with law, or in the good faith belief that such action is necessary to conform to the requirements of law, or comply with legal process served on Us, and to protect and defend Our rights or property, including Our rights and property and Our services, or act in urgent circumstances to protect the personal safety of You and Our other visitors.

  • We may use anonymized or general information derived from the data We collect from You and aggregate it with information from Our other customers and visitors (“Non-Identifiable Aggregated Data”) for Our business purposes, including without limitation for analyzing customer needs and improving Our Application, and We will own all right, title and interest in any such Non-Identifiable Aggregated Data.

  • To protect against fraud and potential fraud.  We may verify the information You provide to obtain the Application. In the course of such verification, We may receive additional personal information about You. 

6.1.     Legal Disclosure

We may disclose information about You and Your use of the services if We believe that such disclosure is reasonably necessary to: (i) comply with the law and/or legal process where a formal request has been made (e.g. request from an administrative oversight agency, civil suit, subpoena, court order or judicial or administrative proceeding); (ii) protect or defend Our rights and/or property or the rights and property of others; (iii) enforce Our Terms of Service and/or this Privacy Policy; and (iv) respond to claims that the content(s) of a communication violates the rights of another.

 

Also, circumstances may arise where, for business reasons, We may decide to reorganize, or divest all or part of Our business through sale, assignment, merger, acquisition, bankruptcy proceedings, or We may acquire a new business.  In these circumstances, personal information may be shared with the actual or prospective purchasers or assignees, or with the newly acquired business. 

7)    People Under the Age of 18

The Application provided by AdKaddy is not directed or available to persons under eighteen (18) years of age.  If You become aware that Your child, who is under eighteen (18) years of age, is accessing the Application and providing personal information without Your consent, please contact Us by using the information provided in the Contact and Electronic Communication section of this Privacy Policy.  AdKaddy will take steps to remove the child’s personal information from AdKaddy’s data collection systems and terminate Your child’s account should AdKaddy determine that a child under eighteen (18) has accessed the Application. 

8)    Security of Information

Information submitted via the Application or e-mail is subject to interception or incorrect routing, as the Internet is not a fully secure communications channel.  Please consider this prior to submitting any information to AdKaddy via the Application or e-mail.  While AdKaddy follows generally-accepted industry standards to protect the information submitted to Us, no method of transmission over the Internet, or method of electronic storage, is completely secure.  Therefore, while AdKaddy strives to use commercially acceptable means to protect Your personal information, AdKaddy cannot guarantee its absolute security.

9)      Social Media

Any information, communications, or material of any type or nature that You submit to the Application or to AdKaddy by e-mail, uploading, downloading, or otherwise, is done at Your own risk and without any expectation of privacy.  AdKaddy cannot control the actions of other users of any application or website and AdKaddy is therefore not responsible for any content or communications contained on such applications and platforms.  By using the Application, You are representing and warranting to AdKaddy that You have reviewed the applicable Privacy Policy and Terms of Service of the Application and that You will abide by all such provisions contained therein.  Additionally, in the event that AdKaddy offers a message board or any other interactive or social-type feature on the Application, please be aware that these areas may allow You to publicly post, and share with other users, certain messages, content, or other information.     Although AdKaddy may take certain precautions to protect those who use these areas of the Application, AdKaddy encourages You to be wary of providing any of Your personal information in such public fora.  The information You submit can be collected and used by individuals or entities You do not know.  AdKaddy does not guarantee the privacy and safety of these areas and is therefore not responsible for any information You choose to submit.  Your use of these features is fully at Your own risk.

10)      International Users

If You are visiting from the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that You are transferring information about You, including personal information, to a country and jurisdiction that does not have the same data protection laws as the European Union, and You consent to the transfer of information about You, including Your personal information, to the U.S.; and the use and disclosure of information about You, including Your personal information, as described in this Privacy Policy.

NOTICE TO CALIFORNIA RESIDENTS – YOUR CALIFORNIA PRIVACY RIGHTS 

This section is applicable to residents of California. If you are a resident of California, you have certain rights described below. The following do not apply to individuals who do not live in California on a permanent basis. 

 

  • RIGHTS PROVIDED BY CALIFORNIA CIVIL CODE SECTION 1798.83 

 

A California resident who has provided personal data to a business with whom he/she has established a business relationship for personal, family, or household purposes (a “California Customer”) may request information about whether the business has disclosed personal information to any third parties for the third parties’ direct marketing purposes. In general, if the business has made such disclosure of personal data, upon receipt of a request by a California Customer, the business is required to provide a list of all third parties to whom personal data was disclosed in the preceding calendar year, as well as a list of the categories of personal data that were disclosed. California Customers may request further information about our compliance with this law by mailing us as set forth in the How to Contact Us section above. Please note that we are only required to respond to two requests per California Customer each year under Code Section 1798.83.  

 

  • RIGHTS UNDER THE CALIFORNIA CONSUMER PRIVACY ACT

 

This section of our Privacy Policy provides California residents with a comprehensive description of the Company’s online and offline practices regarding the collection, use, disclosure, and sale of personal information and the rights of California consumers regarding their personal information under the California Consumer Privacy Act (“CCPA”). This section applies to all California residents (but not including legal entities, such as companies). The section will not apply, however, if Company does not collect any personal information about you or if all of the information we collect is exempt from the statute (for example, the CCPA does not protect information that is already protected by certain other privacy laws, and it does not protect information that is already publicly available).

1.      You have a Right to Know About Personal Information Collected, Disclosed, or Sold.

California residents have the right to request that Company disclose what personal information it collects, uses, discloses, and sells. This is called the “Right to Know”. Under the Right to Know, you can request a listing of the types of personal information we have collected about you, the sources of that information, how we use the information (e.g., our business or commercial purposes for collecting or selling personal information), other individuals and business with whom we share personal information, and the specific pieces of personal information that we have collected about you. 

 

If you would like the above information, you may contact us through our webpage or customer service. Contact information is provided in the How to Contact Us section above. When you make a request under your Right to Know, you can expect the following:

  • We will verify your identity. You will need to provide us the following information in order for us to verify that you are who you say you are:

    1. Your name;

    2. Your address, telephone, and email;

    3. A recent bill showing your name and address; and

    4. A document bearing both your name and signature.

  • We will confirm our receipt of your request within 10 days. If you have not received a response within a few days after that, please let us know by contacting us at the webpage or phone number listed below.

  • We will respond to your request within 45 days. If necessary, we may need an additional period of time, up to another 45 days, but we will reply either way within the first 45-day period and, if we need an extension, we will explain why.

  • In certain cases, a Request to Know may be denied, for example, if we cannot verify your identity or if providing you the information could create an unreasonable risk to someone’s security (for example, we do not want very sensitive information disclosed inappropriately). If we deny your request, we will explain why we denied it. If we deny a request, we will still try to provide you as much of the information as we can, but we will withhold the information subject to denial. 

 

In the last 12 months, Company has collected the following categories of personal information from individuals from the following sources: ​“Personal information,” for purposes of this section regarding rights under the CCPA, does not include publicly available information that is lawfully made available to the general public from federal, state, or local government records.Company does not sell the personal information.​​​​​​​​

2.      You have a Right to Request Deletion of Personal Information about You.

California consumers have a right to request the deletion of their personal information collected or maintained by Company. If you would like information about you to be deleted, you may contact us through our webpage or customer service. Contact information is provided in the How to Contact Us section above. When you make a request for deletion, you can expect the following:

  • After you request deletion, you will need to confirm that you want your information deleted. 

  • We will verify your identity. You will need to provide us the following information

    1. Your name;

    2. Your address, telephone, and email;

    3. A recent bill showing your name and address; and

    4. A document bearing both your name and signature.

You have a right not to receive discriminatory treatment by Company for exercising any of your privacy rights conferred by the CCPA. Company will not discriminate against any California consumer because such person exercised any of the consumer’s rights under CCPA, including, but not limited to:

  • Denying goods or services.

  • Charging different prices or rates for goods and services, including through the use of discounts or other benefits or imposing penalties.

  • Providing a different level or quality of goods or services.

  • Suggesting that the consumer will receive a different price or rate for goods or services or a different level or quality of goods or services.

Company may, however, charge a different price or rate, or provide a different level or quality of goods or services, if that difference is related to the value provided to you by your data.

5.      Authorized Agents

If you would like, you may designate an authorized agent to make a request under the CCPA on your behalf. We will deny requests from agents that do not submit proof of authorization from you. To verify that an authorized agent has authority to act for you, we may require a copy of a power of attorney or require that you provide the authorized agent with written permission and verify your own identity with us.
